DMCA Policy

Easy Fruit Punch is committed to respecting the intellectual property rights of others and expects our users to do the same. This DMCA (Digital Millennium Copyright Act) Policy outlines the procedures for reporting copyright infringement and for responding to such notices.

It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). When we receive a compliant DMCA notice, our response may include removing or disabling access to the material claimed to be infringing.

Filing a DMCA Notice of Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Easy Fruit Punch website, please send a written notice to our designated Copyright Agent with the following information:

  1. Identification of the copyrighted work claimed to have been infringed: Provide a detailed description of the copyrighted work that you claim has been infringed, including where it can be found on our site (e.g., URL of the specific page, description of the content). If multiple copyrighted works are covered by a single notification, please provide a representative list of such works.
  2. Identification of the material that is claimed to be infringing: Provide sufficient information to allow us to locate the material on our site, such as the URL(s) of the specific page(s) where the material is displayed.
  3. Your contact information: Provide your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your electronic or physical signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid DMCA notice, we will promptly investigate the matter and take appropriate action, which may include removing or disabling access to the infringing material.

Filing a DMCA Counter-Notification

If you believe that material you posted on the Easy Fruit Punch website was removed or disabled by mistake or misidentification, you have the right to file a counter-notification. Your counter-notification must be a written communication provided to our Copyright Agent and must include substantially the following:

  • Identification of the material that has been removed or to which access has been disabled: And the location (URL) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number: Sufficient contact information for us to reach you.
  • A statement that you consent to the jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Easy Fruit Punch may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your electronic or physical signature: A physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party and inform them that we may replace the removed material or cease disabling access to it in 10 business days. If the copyright owner does not file an action seeking a court order against you within 10 to 14 business days of receiving the counter-notification, the removed material may be replaced or access restored.
